<p>In making the decision a good attorney will assess such factors as your objectives, the nature of the matter involved, the evidence you have available and what you still need, the need for an ongoing relationship between the parties, the relative strength of your case and the other side’s case, the parties’ resources, the value of any precedent to you, what court you would be heard in, how long it would take to go to trial, who your adversary and her attorney is in making a recommendation.</p>
<p>Sometimes a good attorney will urge you to settle the matter quickly and avoid any litigation, sometimes the lawyer will urge ADR, and other times the lawyer will conclude traditional litigation, not ADR, will be in your best interests</p>

Litigation is one way that people and companies resolve disputes arising out of an infinite variety of factual circumstances.</p>
<p>The term &#8220;litigation&#8221; is sometimes to distinguish lawsuits from “alternate dispute resolution” methods such as &#8220;arbitration&#8221; in which a private arbitrator would make the decision, or “mediation” which is a type of structured meeting with the parties and an independent third party who works to help them fashion an agreement among themselves.</p>

<p>“Family violence” is a term that includes many different forms of physical or psychological abuse or neglect. It can be experienced by adults or children in a family.</p>
<p>Many forms of family violence are crimes, including:</p>
<p>-physical abuse (such as hitting, punching, kicking, burning, cutting, stabbing, forcibly confining or shooting);</p>
<p>-sexual abuse (such as any unwanted sexual touching or sexual activity and any sexual conduct with children)</p>
<p>-some forms of psychological abuse (such as threatening violence, destroying property, stalking),</p>
<p>-financial abuse (such as taking a pay cheque, failing to provide the necessaries of life).</p>
<p>Other forms of family violence are not crimes but are often signs that violence will get worse (such as yelling, humiliating, controlling movements).</p>
<p>Family violence can have serious - and sometimes fatal - consequences for victims and those that witness the violence.</p>
<p>If your spouse physically or psychologically abused you or your children, your family&#8217;s future safety becomes of primary concern. There are many people and organization available to help you in this situation, such as attorneys, social workers, counsellors, support groups or your local shelter or transition house. Traditional mediation or counselling with your spouse may not be appropriate in these circumstances. However, in some provinces or territories, specialized counselling procedures have been developed to support couples when there are concerns about violence.</p>
